All orders of COVID 19 products as published on COVID 19 Gears on this website require 80% non-refundable deposit, with the 20% balance payment due on delivery.
Once your order is in production and merchandise has been decorated, your deposit becomes non-refundable as decorated merchandise is only unique for your use.
For all Orders under $2500, Payment is Required in Full with an Official Purchase Order.
All Orders over $2500 a 60% Deposit is Required with an Official Purchase Order and the Balance to be Paid in Full on Delivery of Goods.
Indent Orders: 80% Deposit with Official Purchase Order and Balance to be Paid in Full Prior to Delivery
Credit Card Payments: All MasterCard & Visa Credit card payments are plus 1.48%.
We are happy to send out samples, but as we have to purchase these from the manufacturers, we charge for these at a nominal rate, plus postage of $20 flat. If the samples are returned in their original condition to our designated address within 14 Days in good condition and original packaging, we will credit the cost of this less freight and a small handling fee. If you proceed in placing an order, these charges are normally credited against your order. All products are custom printed to the Purchaser's specification. Once printed all costs incurred will be passed on to the Purchaser. If an order is cancelled, M&M Professionals is not bound by any terms, conditions, stipulations or Prices contained on customer's purchase order forms.
All orders for products and services purchased from M&M Professionals must be confirmed in writing by fax, post or email. Purchase orders must have an order number with billing and delivery addresses clearly shown.
Changes to the PO must be made in writing and must be approved by the M&M Professionals prior to the changes becoming effective. Emailing a request without any confirmation by M&M Professionals will not be considered a valid change and customer will be billed for the original order. The customer is responsible for any and all incurred costs prior to change approval. If the customer does not receive a confirmation of the change it may not have been received or approved.
Orders for Goods which have to be made especially or Decorated for the Customer will be charged in full unless written notice of cancellation is received prior to manufacture or decorating of the goods or any components for them has not commenced at the date of that notice.
All COVID 19 Gears orders (products featured under COVID 19 pages on mmprofessionals.com.au) must be paid upfront, upon placing the orders. Cancellation of any COVID 19 UNBRANDED Gears orders may be refundable. A written approval from M & M Professionals must be obtained prior. Cancellation of COVID 19 UNBRANDED Gears is subject to Force Majeure Clause. Cancellation of COVID 19 UNBRANDED Gears due to border closures, government lock down regulations, custom delays, transport failure, industrial action, suppliers delay, manufacturers delay Act of God, war, strike, lock-out or any other labour dispute, fire, flood, drought, terrorist attacks, any other uncontrolled conditions which forces M & M Professionals to not be able to deliver on time, and any other government legislations impacting supply-chain time frame, is not refundable.
All returns must be authorised with an M & M Professionals Return Reference Number prior to shipment. Goods returned will not be accepted freight-on, unless prior arrangement. Unauthorised returns will not be accepted. Claims must be made in writing and received by M&M Professionals within 7 days of the delivery date. Claims made after 7 days will not be considered. M&M Professionals reserves the right to determine if a product is faulty and be replaced, not credited.
(a) M & M Professionals' warranties
Unless expressly set out herein, all implied warranties and conditions in relation to any supply by M & M Professionals are expressly excluded (unless such warranties cannot at law be excluded). However, M & M Professionals shall, if reasonably possible, pass on to the Customer the benefit of any manufacturers' warranties.
(b) Customer warranties The Customer warrants and represents to M & M Professionals that:
i. It is the owner or licensee of the Intellectual Property used in the Artwork for the Goods and it has the right to use, publish, licence or otherwise deal with the Artwork;
iii. The Artwork does not infringe the Intellectual Property or other similar rights of a person or contravene any applicable laws; and
iii. The Customer will indemnify M & M Professionals against any loss and in respect of any claim alleging that the Artwork or any other material supplied to M & M Professionals by the Customer infringes Intellectual Property or other similar rights or contravenes any applicable law.
(a) Where the Customer acquires Goods and/or Services as a Consumer, nothing in these terms and conditions should be interpreted as attempting to exclude, restrict or modify either the exercise by the Customer of rights or remedies in respect of the Consumer Guarantees or any other rights or remedies conferred by the Australian Consumer Law or the application of the Consumer Guarantees or any other provision of the Australian Consumer Law.
(b) If the Customer acquires Goods and/or Services as a Consumer and the Goods and/or Services supplied are Non PDH Goods or Services, then M & M Professionals' liability to the Customer for any claim in respect of a breach or alleged breach by M & M Professionals of the Consumer Guarantees is limited, at M & M Professionals option to:
i. in the case of Goods:
(A) the replacement of the Goods or the supply of equivalent goods;
(B) the repair of the Goods;
(C) the payment of the cost of replacing the Goods or of acquiring equivalent goods; or
(D) the payment of the cost of having the Goods repaired; and
ii. in the case of Services:
(A) the supplying of the Services again; or
(B) the payment of the cost of having the services supplied again.
(C) Where the Customer does not acquire Goods and/or Services as a Consumer or where any claim or Loss relates to a non-Australian Consumer Law Claim, then to the extent permitted by law, M & M Professionals excludes all liability for any Loss or claim incurred by Customer in respect of the Goods and/or Services and/or any Non Australian Consumer Law Claim. This clause applies even if M & M Professionals knew or ought to have known that it was possible or foreseeable that the Customer would incur such Loss.
Prices and products are subject to change without notice which can be due to currency fluctuation. This is not applicable to confirmed orders that are delivered in the time frame as stated in M&M Professionals Quotations, where a deposit has been paid. If you require the goods to be delivered outside the time frame as quoted in M&M Professional's Quotation, we reserve the right to pass on any increases incurred.
Ownership title of goods remains with the seller until payment has been made in full into our account or cheques cleared.
Non-payment of products supplied by M&M Professionals will be pursued vigorously. Legal fees, debt collection fees and all our costs spent on this recovery will be sought. Interest of 1.5% per month, calculated daily will apply from the due date of the invoice.
Delivery lead-times shown are indicative only. M&M Professionals will do everything within our control to meet these, however factors out of our control (i.e. Shipping & Freight & Custom delays, Seasonal events such as Chinese New Year, Christmas etc can impact the ultimate time from order to local dispatch. M&M Professionals will not be held accountable or responsible if these lead-times are not met due to these factors. If you have concerns, please contact us to discuss.
M&M Professionals makes every effort to supply products accurately and timely, but no responsibility can be accepted by M&M Professionals for any loss whether consequential or otherwise arising from any delay in completing the Work or for any failure on our part which results from any cause beyond the Company's reasonable control including (but not limited to): COVID 19 border closures, government lock down regulations, custom delays, transport failure, industrial action, suppliers delay, manufacturers delay Act of God, war, strike, lock-out or any other labour dispute, fire, flood, drought, terrorist attacks, and any other government legislations impacting supply-chain time frame.
Freight is not included and will be charged separately on your Tax Invoice
The printing industry recognises PMS or Pantone colour standards as a guide and can reproduce your exact colour in most cases. However if you are in doubt we recommend a production sample.
M&M Professionals will supply the Purchaser with proofs or paper artwork samples showing expected printing content and layout. Approval of the design is an acceptance that the elements e.g. spelling, positioning and colour of the logo is correct. A digital artwork sheet will be emailed to you within 24hrs for approval. Artwork must be supplied in EPS Vector PDF, EPS if artwork cannot be supplied in correct format, additional design charges may apply.
Due to the nature of some products an industry standard tolerance of 5% over or under ordered quantity will be considered complete. Where exact quantities are require a fee may apply to fulfill this request.Please state any such prerequisite at time of quotation.
The prices on our M&M Professionals Website are indicative only and all Pricing will be confirmed once we have sited all Artwork for the proposed Promotional Products you have selected. M&M Professionals shall in no event be liable for any damage or costs incurred as a result of the accuracy of product information and specifications contained in this website. It is the Purchaser's responsibility to ensure the products they purchased are suitable for the proposed use.
M&M Professionals may amend these Terms from time to time, by written notice to the Customer, provided that the amended Terms will only apply to orders placed after the date of such notice.
